PRIVACY POLICY

1 - General information

The purpose of this Privacy Policy (the “Policy”) is to formalize Terapro's commitment to the protection of Personal Information (as defined below) and to inform you of the types of Personal Information that Terapro collects, uses and discloses, including in connection with the operation of the emplois.terapro.ca recruitment site.

The Policy applies to all Internet users of the website (hereinafter referred to as “the User” or “you”) accessible from the URL emplois.terapro.ca (hereinafter referred to as the “Site”) and operated by Terapro, in particular candidates who submit their applications. To facilitate recruitment, Terapro uses DigitalRecruiters software, published by BANKESS, to post job offers, collect applications and manage them.

 

The Policy does not apply to Personal Information about our subcontractors.

 

The following sections provide information on: 

·       What Personal Information we collect and how we collect it; 

·       The extent of your consent;

·       The security and governance measures we use to protect it;  

·       The purposes for which we use it;

·       How we communicate and store it; 

·       Your rights and how to exercise them. 


 

2 - Scope of the Privacy Policy

 

This Policy applies to all Personal Information about you that we collect or receive from any source.

Personal Information” is any information relating to a natural person that makes it possible, directly or indirectly, to identify that person.

 

We collect only the Personal Information about you that is necessary to establish, manage and maintain our relationship with you. This collection is limited, in the majority of cases, to your surname, first names, postal address, telephone number, e-mail address, training, professional experience, diplomas, distinctions, interview reports and, more generally, any information and personal data that you provide spontaneously as part of your application (e.g. CV and covering letter) and that are necessary for Terapro to analyse it, as well as connection cookies.

 

Answers to fields marked with an asterisk on the Site are compulsory, and failure to answer may jeopardize the processing of your application. In other cases, they are optional and have no effect on the processing of your application.

 

3 - Collection of Personal Information

 

In most cases, we will collect Personal Information directly from you when you:

·       Create a profile on the Site;

·       Apply for a job;

·       Add your resume to your profile;

·       Add a cover letter to your profile;

·       Connect to our Site via your LinkedIn account;

·       Contact our teams by e-mail; and

·       In general, when you use our Site.

Terapro informs you that it may also enrich your profile with information concerning you, i.e. information collected (i) during its exchanges with you, whether written, by telephone or in person, and (ii) from professional social networks or from any public information source, when this information is useful for the management of your application.

 

This information is processed for the purpose of managing your application. With your consent, your data may also be included in a CV database, which will enable Terapro to offer you other job opportunities, where appropriate, for the period specified in article 7 hereof.

4 - Disclosure of your personal information

·       To Whom? 

Given its purpose, which consists of processing the Personal Information of candidates responding to job offers and the integration of candidate data within Terapro's CV library, the processing of your Personal Information is necessary to pursue Terapro's legitimate interests, namely the management of its recruitment processes, as well as the execution of pre-contractual measures that may exist between Terapro and candidates responding to its job offers.

 

These data will be transmitted to the persons in charge of recruitment within Terapro in order to enable them to study your application.

 

In its capacity as a subcontractor of Terapro, BANKESS is authorized to access your Personal Information when necessary, in particular as part of its duties to administer and maintain the Site and the application management tool, but may not communicate this data, except to subcontractors for the purposes of hosting and processing this data compatible with the purposes of the collection.

 

We may also disclose Personal Information to third parties in specific circumstances permitted by law. The table below summarizes these circumstances and the measures we take to protect Personal Information.

We sign contracts with subcontractors and agents in order to provide you with a service and/or improve existing services. 

A contract obliges subcontractors to:

·       Use only the Personal Information required to provide the service; 

·       Refrain from disclosing or communicating Personal Information without our consent;

·       Implement rigorous security measures;

·       Allow us to audit these measures;

·       Notify us immediately of any breach of confidentiality;

·       Destroy Personal Information at the end of a contract.

To another party in a business transaction.

 

Such a transaction is defined as the disposal or lease of all or part of our business or its assets, a change in our legal structure by merger or otherwise, the obtaining of a loan or any other form of financing, or a security interest taken to guarantee one of our obligations (hereinafter :

the “Business Transaction”). 

Conclude a business transaction.

A contract obliges the other party to:

·       Use only the Personal Information necessary to complete the Business Transaction;

·       Implement rigorous security measures;

·       Refrain from disclosing or communicating Personal Information without our consent;

·       Notify us immediately of any breach of confidentiality;

·       Destroy Personal Information if the Transaction is not completed or if it is no longer required to complete the Transaction.

To legitimate authorities.       

In order to comply with a court order or decision, including a valid search warrant, or a regulatory authority, we may be required to provide Personal Information.

 

The laws governing these authorities require them to put measures in place to respect and preserve the confidentiality of your Personal Information.

 

In general, we refuse to provide access to such information if the request is not legally binding.

To our lawyers and prosecutors.

In order to defend ourselves or assert our rights, we may, in certain cases, disclose your Personal Information.  

Both the law and the mandate letters we sign oblige our lawyers to protect the confidentiality of all our communications with them.

 

·       Where do we send it?

We may disclose Personal Information outside Quebec, including in France where Personal Information is hosted and processed.

 

Before disclosing Personal Information outside Quebec, we will conduct a Privacy Impact Assessment that takes into account:

·       The sensitivity of the Personal Information;

·       The purpose for which it will be used;

·       the safeguards available to protect it; and

·       The legal regime applicable in the country where the Personal Information is to be disclosed.

We will only disclose Personal Information if this assessment demonstrates that the Personal Information will be adequately protected in accordance with generally accepted privacy principles. In addition, any such disclosure will be subject to a written agreement that takes into account all the findings of the assessment.  

5 - Your consent

 

Your consent to the collection, use or disclosure of your Personal Information must be manifest, free and informed. Consent must be given for the specific purposes and objectives identified in this Policy.

 

Depending on the nature and sensitivity of your Personal Information, consent may be express if it is expressed through specific words or gestures, or implied if it can be inferred from the conduct of the person whose Personal Information is collected, used or shared.

 

BY COMPLETING THE FORM ON THE SITE, YOU CONSENT TO THE COLLECTION, USE, DISCLOSURE AND RETENTION OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY. PLEASE READ IT CAREFULLY.

 

If you do not consent, please stop using the Site. Except where otherwise provided by law, you may withdraw your consent at any time upon reasonable notice. Please note that if you choose to withdraw your consent to the collection, use or disclosure of your Personal Information, certain features of our Site may no longer be available to you or we may no longer be able to analyze or manage your application.

6 - Use of Personal Information

 

Except in accordance with the Policy, and unless permitted or required by law, Terapro does not collect, use or share Personal Information without your prior consent.

 

We generally use your Personal Information for the following purposes:

·       To process your application;

·       To respond to your requests and questions;

·       Analyze your responses and profile for recruitment purposes;

·       Propose job offers in line with your profile or professional wishes;

·       Obtain statistics on the use of the Site, including allowing BANKESS to obtain such statistics on an anonymous basis.

All our employees who use Personal Information are bound by confidentiality obligations and have received appropriate training. In addition, they may only have access to Personal Information that is necessary for the performance of their respective duties. Our governance policies and practices provide for sanctions in the event of non-compliance.

 

7 - Retention

 

Except where legal requirements or contractual interests recognized by law oblige us to retain it for a longer period, the Personal Information of external candidates will be retained only for the time necessary to achieve the purposes for which it was collected, but at the latest until the expiry of a period of 24 months after your last contact with our recruitment department, the notion of “last contact” being understood as the date on which you consented to the collection of your Personal Information. In the case of internal applications, Personal Information is retained for the duration of the employee's employment with the company.

 

We reserve the right to establish Personal Information destruction policies from time to time. If you request the destruction of your Personal Information, we will use reasonable efforts to comply with your request as quickly as possible. Your Personal Information will be deleted within 30 days of your request.

8 - Security and governance

 

Information security is a priority for us. In addition to the administrative measures detailed in the following sections, we have put in place physical and technological measures that are reasonable in light of the sensitivity of Personal Information, its use, quantity, distribution and medium.

 

9 - Your rights

 

By providing your Personal Information, you declare that it is accurate and that you are not impersonating any third party. You may modify the Personal Information in your profile at any time.

 

The User also has the following rights with respect to his or her Personal Information:

·       The right to be informed of the use, disclosure, retention and destruction of your Personal Information, as set out in this Policy;

·       The right to access your Personal Information and to obtain, where appropriate, further details on how we use, disclose, store and destroy it;

·       In some cases, the right to object to, restrict or withdraw your consent to these operations upon reasonable notice sent to the e-mail address provided at the end of this Policy;

·       The right to have your Personal Information corrected if it is inaccurate or misleading, and to have it completed if it is incomplete;

·       The right to have your Personal Information deleted, subject to our legal obligations;

·       The right to be informed of a privacy incident involving your Personal Information that may cause you serious harm. To this end, we maintain a register of all privacy incidents and assess the harm they may cause. 

 

You may exercise these rights at any time by contacting us. You must make this request in writing and send it to us by e-mail at the e-mail address provided at the end of this Policy, enclosing proof of your identity. In such a case, any information provided to identify you will be used solely for this purpose. We will respond within thirty (30) calendar days of receipt of your request, except where the law permits an extension.

 

Subject to legal restrictions, if we refuse to provide you with or correct your information, we will provide you with the reasons for the refusal, information about your recourse and the applicable sections of the law.

 

If we refuse to rectify your Personal Information, we will allow you to add to your file written comments regarding the Personal Information for which rectification has been refused. We will also retain Personal Information that has been the subject of an access request for as long as necessary to allow you to exhaust any recourse provided by law.

 

10 - Communications

 

You may choose to stop receiving electronic communications from Terapro by unsubscribing through the mechanism indicated in such communications or by sending us a written request by e-mail.

 

11 - Cookies

 

Your use of the Site allows us to automatically compile certain information, known as cookies, which may include:

·       The Internet Protocol (IP) address of your computer;

·       Your geolocation zone;

·       The operating system you are using;

·       Language preference;

·       The identity of your Internet service provider;

·       The date and time you accessed the Site;

·       The previous website you visited that provided you with a link to our Site; and

·       The content viewed and downloaded on our Site or the number of visits.

13 - Changes

 

Terapro reserves the right to modify the content of this Policy at any time. Any changes will be posted on our Site and will be brought to your attention when you visit our Site. We recommend that you print a copy of this Policy for your records and review this section of our Site periodically.

 

14 - Jurisdiction and applicable law

 

Without prejudice to your right to take legal action against Terapro in any court of competent jurisdiction, this Policy is governed by the laws of the Province of Quebec and the laws of Canada applicable therein.
